About Gang Cases in Ventura County

California gang law adds significant enhancements on top of underlying charges. Penal Code Section 186.22(a) criminalizes active participation in a criminal street gang; Section 186.22(b) is the primary sentencing enhancement (adding 2, 3, or 4 years, or more for serious/violent felonies), and can add 10 years, 15 years to life, or 25 years to life depending on the underlying offense. Sections 186.30-186.33 govern gang registration. AB 333 (2022) significantly narrowed the definition of a “criminal street gang” and the proof required, giving defense counsel new tools to strike gang allegations.

Ventura County has both East County and West County gang enforcement teams, and prosecutors regularly file gang allegations in shooting, robbery, and vandalism cases in Oxnard and parts of Ventura. Under AB 333, the prosecution must now prove the pattern-of-criminal-activity predicate offenses were committed by two or more gang members, that they benefited the gang more than reputationally, and that the primary activities are one of the specific listed offenses. These heightened requirements have led to numerous successful motions to strike the enhancement.
