California distinguishes theft offenses primarily by value and method. Penal Code Section 484 defines theft generally; Section 488 covers petty theft (value $950 or less, misdemeanor); Section 487 is grand theft (over $950, from a person, or specified property, a wobbler). Section 211 is robbery (a felony strike offense) and Section 459 is burglary (entering a structure with intent to commit theft or a felony). First-degree burglary (residential) is a serious felony strike carrying 2, 4, or 6 years in state prison. Post-Prop 47, many petty-theft cases that would have been felonies are now misdemeanors capped at 1 year in county jail.
