Drugs
For users and sellers alike, drug laws just got harsher with the passage of Prop 36 in 2024.
Protecting Your Rights Against California’s Tougher Drug Laws
California’s drug laws became significantly stricter following the passage of Proposition 36 in 2024. Offenses that were once treated as low-level crimes can now carry substantially harsher penalties, including felony charges and potential prison sentences for individuals with certain prior convictions. Whether you are accused of simple possession, possession for sale, trafficking, manufacturing, or another drug-related offense, an experienced defense attorney can evaluate the evidence, challenge unlawful searches and seizures, and pursue every available strategy to protect your rights and your future.
Do not settle for an attorney looking for the easiest way to settle your case.

About Drug Cases in Ventura County
Ventura County drug prosecutions turn on the specific charging statute. California Health & Safety Code Section 11350 covers possession of a controlled substance, Section 11351 possession for sale, Section 11352 transportation, Section 11357 cannabis-related offenses, and Section 11550 being under the influence of a controlled substance. Since Prop 47 (2014) many simple possession cases are charged as misdemeanors carrying up to 1 year in county jail; sales, transportation, or possession-for-sale can be felonies with 16 months to 5 years in state prison. Enhancements apply for prior strikes, quantities exceeding statutory thresholds, and offenses near schools or involving minors.
The Ventura County Superior Court operates a dedicated Drug Court program for eligible non-violent offenders — completion typically dismisses the charge. Common defenses include Fourth Amendment challenges to warrantless searches (vehicle, home, or person), attacking constructive possession where the substance was not on the defendant, disputing lab identification and chain of custody, and PC 1000 diversion for first-time simple possession. Under Penal Code 1000, eligible defendants can complete an approved education/treatment program and have the charge dismissed.
Hali Ford handles simple possession, possession for sale, transportation, and DUI-drug charges throughout Ventura County. Every case begins with a review of the search circumstances, the lab report, and diversion eligibility. Learn more about criminal defense practice, related offenses like DUI or weapons charges.
